THE DPP DISMISSED THE CASE AGAINST DR. PIMA AND HIS COLLEAGUES

 



PREVIOUSLY, The Former Director Of The City Of Arusha Dr. John Pima And His Two Colleagues Were Sentenced To 20 Years In Prison In The Case Of Economic Sabotage Number 5/2022. The Director Of Public Prosecutions (DPP) Has Dismissed Two Cases Of Economic Sabotage Against The Former Director Of The City Of Arusha, Dr. John Pima And His Three Colleagues And Reopened Two Other Cases Of Economic Sabotage.

Apart From Dr. Pima, Others Are The Former Treasurer Of The City, Mariam Mshana, The Former Head Of The Planning, Statistics And Monitoring Department, Innocent Maduhu, Nuru Ginana (A Former Economist) And Alex Daniel.

Yesterday, Wednesday March 20, 2024 In Front Of The Arusha Resident Magistrate's Court, The Canceled Cases Were Scheduled To Read The Preliminary Information To The Suspects, But The Republic's Side Led By The State Attorney, Hebel Kihaka Explained To The Court That The DPP Has No Intention Of Continuing With The Case Those.

He Has Explained That They Are Requesting To Withdraw The Proceedings Under Section 91(1) Of The Criminal Procedure Act (CPA) Chapter 20.

Among The Dismissed Cases Is The Economic Sabotage Case Number 3/2022 Which Was Facing Dr. Pima, Mariam, Madhu And Ginana Who Are Facing Four Crimes Including Embezzlement And Embezzlement And Use Of Documents With The Aim Of Deceiving The Employer.

After Being Read The Charges, The Three Suspects, Namely Dr. Pima, Mariam And Madhu, Who Were Represented By Three Lawyers Led By Lawyer Sabato Ngogo, Denied Committing The Crimes While The Fourth Accused In Each Case (Ginana And Alex), Who Were Not Represented By Lawyers, Denied Committing The Crime. Those Mistakes.

After The New Charges Were Read, The Three Defendants Dr. Pima, Mariam And Maduhu Were Released After Meeting The Bail Conditions While Ginana And Alex Were Sent To Prison After Failing To Meet The Bail Conditions.

The Judge Who Was Hearing The Cases Has Adjourned Them Until April 3, 2024 Where The Cases Have Been Scheduled For The Suspects To Be Read Preliminary Information.

Speaking Outside The Court, Lawyer Ngogo Said Apart From The Case, Dr. Pima Is Currently Facing Another Case Of Economic Sabotage Number 6,931 Of The Year 2024 Where He And His Three Colleagues Who Are Not The Accused In Those Cases Are Facing Seven Offences.

He Has Mentioned That The Offense Is Using Documents To Deceive The Employer And Causing The Government A Loss Of Sh60 Million, A Case In Which However Dr. Pima Could Not Be Prosecuted By His Colleagues Because When They Were Brought To Court He Was Sick, So He Will Be Prosecuted When The Case Is Mentioned On April 9, 2024.

On May 24, 2022, Prime Minister Kassim Majaliwa Suspended Six Employees Of The Arusha City Council, Including Dr. Pima, To Investigate Allegations Of Embezzlement And Misuse Of Public Funds.

Dr. Pima, Mariam And Maduhu Were Facing A Case Of Economic Sabotage Number 5/2022, They Were Sentenced To 20 Years In Prison For Nine Crimes They Were Facing Including Money Laundering Sh103 Million.

Pima And His Colleagues Appealed Against The Sentence Which Was Being Heard By Judge Mwipopo Angaza Who Said That Permission To Prosecute Any President's Nominee Must Be Signed By The DPP Himself.

Pima And His Colleagues Were Sentenced To Prison On August 31, 2023 Before Being Released On February 16, 2024 And Among The Reasons For Pima's Detailed Appeal Against The Sentence Is That The Judge Made A Legal Mistake When He Sentenced Them Without Authority, The Indictment Was Flawed And The Operation Was Covered By Flaws Legal.
