COURT DISMISSES CASE OF PRESIDENTIAL CANDIDATE THROUGH CCM PARTY


THE HIGH COURT, Dodoma, has dismissed the Constitutional case challenging the nomination of Samia Suluhu Hassan to contest for the presidency in the October 29, 2025 General Election.

The case was dismissed today, August 22, 2025, by a panel of three judges who heard it, Joachim Tiganga (panel leader), Everisto Longopa and Griffin Mwakapeje due to violation of the CCM Constitution and Electoral Rules and the difference in the plaintiff's names on the oath.

The case was filed by a former CCM member, Dr. Godfrey Malisa, a resident of Moshi, Kilimanjaro Region, against the registered CCM Trustees (first defendant) and the CCM Secretary General (second defendant).

However, before the case was heard, CCM in its written response supported by the oath of one of its trustees, Captain George Mkuchika, denied violating the procedure, claiming that all party procedures were observed, while raising the initial objection.

Reading the brief decision of the High Court of Tanzania on the application, Judge Joachim Tiganga said that the objections raised by CCM lawyers have been considered, including the legal shortcomings that emerged in the plaintiff's oath.

He said that the oath had shortcomings that cannot be ignored, including the fact that the person who took the oath had three different names, which is not legally acceptable, and therefore it is not known who actually took the oath.

In the oath, the name of the person who wrote the oath is Dr. Godfrey Fatael Mlamie Malisa, while the person who signed the end of the oath is Godfrey Fatael Mlamie Malisa and the person who swore to the commissioner of oaths is Godfrey Fatael Malisa, these names indicate that they are three different people.

Dr. Samia, was approved by the CCM National Conference, January 19, 2025, to be the presidential candidate in the General Election scheduled for October 29, 2025.
